These Terms & Conditions apply to all website visitors, customers, and purchasers of Rivergum Range products.

1. About Rivergum Range

Rivergum Range supplies commercial furniture, soft seating, partitions, ottomans, bean bags, acoustic products, office furniture, and related products for commercial, education, workplace, community, and residential environments.

Some products may be standard stock items, while others may be made to order, customised, upholstered, printed, or manufactured specifically for the customer.

2. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

Our goods come with consumer guarantees that cannot be excluded under Australian law. If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, or other remedy depending on the issue. The ACCC explains that consumers are entitled to a remedy when a product or service does not meet consumer guarantees.

These Terms & Conditions are intended to operate alongside your rights under Australian Consumer Law, not replace them.

3. Product Information

We make every reasonable effort to ensure that product descriptions, images, colours, sizes, materials, specifications, and pricing shown on our website are accurate.

However:

• colours may vary slightly depending on screen settings, lighting, fabric batch, photography, and manufacturing processes;

• measurements may vary slightly due to manufacturing tolerances;

• product images may be for illustration purposes only;

• natural materials, fabric textures, printed designs, and upholstery finishes may vary slightly from product to product.

Any minor variation that does not affect the overall function, quality, or intended use of the product will not be considered a fault.

4. Pricing

All prices are listed in Australian dollars unless stated otherwise.

Prices may include or exclude GST depending on how they are displayed on the website. The applicable GST treatment will be shown at checkout or on your invoice where required.

Rivergum Range reserves the right to change pricing, product availability, delivery charges, and promotional offers at any time without notice.

If a product has been listed with an obvious pricing error, we reserve the right to cancel or amend the order before dispatch or production begins.

5. Orders

When you place an order through our website, you are making an offer to purchase the selected product or products.

An order is only accepted once we confirm the order, receive payment or deposit where required, and approve the order for processing.

We reserve the right to decline or cancel an order where:

• the product is unavailable;

• there is a pricing or website error;

• payment has not been received;

• delivery is not available to the requested location;

• the order contains incorrect or incomplete information;

• the order is suspected to be fraudulent or inappropriate.

6. Made-to-Order and Custom Products

Many Rivergum Range products may be made to order or customised, including but not limited to:

• custom fabric selections;

• custom colours;

• custom printed designs;

• Aboriginal or Indigenous design fabric products;

• upholstered products;

• partitions;

• ottomans;

• bean bags;

• acoustic products;

• custom sizing;

• commercial project orders.

Once a made-to-order or customised product has entered production, the order generally cannot be cancelled, changed, refunded, or returned unless required under Australian Consumer Law.

This is because the product has been made specifically for your order and may not be suitable for resale.

7. Fabric, Colour and Design Approval

Where applicable, customers are responsible for checking and approving fabric selections, colours, artwork, designs, sizes, specifications, and order details before production begins.

For custom printed or design-based products, artwork proofs, mock-ups, or product previews may be provided where relevant. Approval of a proof or specification means you accept the design, layout, colour direction, wording, sizing, and general appearance of the product.

Rivergum Range is not responsible for errors approved by the customer, including incorrect spelling, wrong colours, wrong sizes, wrong fabric choices, or incorrect design selections.

8. Lead Times

Product lead times vary depending on stock availability, fabric supply, production workload, order size, freight availability, and supplier timelines.

Any lead times provided are estimates only and are not guaranteed unless expressly confirmed in writing.

Rivergum Range will make reasonable efforts to complete and dispatch orders within the estimated timeframe, but we are not liable for delays outside our reasonable control.

9. Delivery

Delivery charges may vary depending on product size, weight, delivery location, access conditions, and freight method.

Customers must ensure that delivery details are accurate and that the delivery site is safe and accessible.

Additional charges may apply where:

• incorrect delivery details are provided;

• the delivery location is unattended;

• redelivery is required;

• access is difficult or restricted;

• stairs, lifts, loading docks, or special handling are required;

• freight carriers charge additional fees.

Risk in the products passes to the customer once the goods are delivered, collected, or handed to a freight carrier, except where the law provides otherwise.

10. Inspection on Delivery

Customers should inspect all goods as soon as possible after delivery.

If goods arrive damaged, incorrect, or incomplete, you must notify Rivergum Range as soon as reasonably possible and provide photos, order details, and a description of the issue.

Please do not dispose of packaging or use the product if you believe it may be damaged or incorrect, as this may affect our ability to assess the issue.

11. Returns and Change of Mind

Rivergum Range does not generally offer refunds or returns for change of mind, incorrect choice, unsuitable colour, incorrect size selection, or customer ordering error.

This includes situations where the customer:

• changes their mind;

• no longer requires the product;

• selected the wrong product, colour, fabric, or size;

• found another product elsewhere;

• decides the product does not suit their space;

• ordered a custom or made-to-order item.

Under Australian Consumer Law, businesses are generally not required to provide a refund or replacement where a customer simply changes their mind, provided the product meets the consumer guarantees. Consumer Affairs Victoria gives similar guidance on change-of-mind returns.

This policy does not affect your rights if the product is faulty, not as described, unsafe, or fails to meet a consumer guarantee.

12. Faulty, Damaged or Incorrect Products

If a product is faulty, damaged, not as described, or fails to meet a consumer guarantee, Rivergum Range will provide a remedy in accordance with Australian Consumer Law.

Depending on the circumstances, the remedy may include:

• repair;

• replacement;

• refund;

• resupply of services;

• partial refund;

• another suitable remedy.

The appropriate remedy may depend on whether the issue is minor or major. The ACCC states that remedies for consumer guarantee failures can include repair, replacement, refund, cancellation of services, or compensation depending on the issue.

13. Warranty

Some Rivergum Range products may come with a manufacturer’s warranty or product warranty. Warranty periods and conditions may vary by product.

Any warranty offered is in addition to your rights under Australian Consumer Law.

Warranty does not cover damage caused by:

• misuse;

• neglect;

• normal wear and tear;

• improper installation;

• incorrect cleaning;

• exposure to unsuitable environments;

• vandalism;

• unauthorised repairs or modifications;

• commercial misuse outside the intended product rating;

• damage caused after delivery.

Proof of purchase may be required for warranty claims.

14. Commercial Use

Many Rivergum Range products are designed for commercial environments. However, customers are responsible for ensuring that the selected product is suitable for their intended use, environment, traffic level, cleaning requirements, safety requirements, and applicable project specifications.

Where a product is used in a high-use commercial environment, reasonable wear and tear should be expected over time.

15. Product Care

Customers are responsible for following all care, cleaning, and maintenance instructions provided by Rivergum Range or the manufacturer.

Failure to follow care instructions may void applicable warranties or affect any claim relating to product condition.

Harsh chemicals, abrasive cleaners, excessive moisture, outdoor exposure, direct sunlight, and improper use may damage fabrics, finishes, foams, frames, or other materials.

16. Website Content

All website content, including images, text, product descriptions, logos, graphics, designs, and layout, is owned by or licensed to Rivergum Range unless otherwise stated.

You must not copy, reproduce, modify, distribute, or use our website content without written permission.

17. Aboriginal and Indigenous Designs

Where products feature Aboriginal, Indigenous, or First Nations artwork or fabric designs, all artwork remains the intellectual property of the relevant artist, designer, licensor, or rights holder.

Customers must not reproduce, copy, modify, scan, print, resell, or otherwise use any artwork or design outside the product purchased unless they have written permission from the relevant rights holder.

Rivergum Range respects the cultural and artistic ownership of First Nations designs and aims to present these products with care and respect.

18. User Accounts

If our website allows you to create an account, you are responsible for keeping your login details secure.

You are responsible for all activity that occurs under your account unless caused by our negligence.

We reserve the right to suspend or terminate accounts that are misused, fraudulent, or in breach of these Terms & Conditions.

19. Payment

Payment must be made using the payment methods available on our website or as otherwise agreed in writing.

Orders may not be processed, dispatched, or placed into production until payment or any required deposit has been received.

For commercial or account customers, separate payment terms may apply if confirmed in writing by Rivergum Range.

20. Cancellations

For standard stock items, cancellation requests may be considered if the order has not yet been dispatched or processed.

For made-to-order, custom, upholstered, printed, or specially ordered products, cancellation may not be possible once materials have been ordered, production has started, or the order has been confirmed.

Any approved cancellation may be subject to reasonable costs already incurred by Rivergum Range.

21. Limitation of Liability

To the maximum extent permitted by law, Rivergum Range is not liable for indirect, incidental, special, or consequential loss, including loss of profit, loss of business, project delays, or loss arising from product misuse.

Nothing in this clause limits any rights you may have under Australian Consumer Law or any other law that cannot be excluded.

22. Force Majeure

Rivergum Range is not responsible for delays or failure to perform obligations caused by events outside our reasonable control, including but not limited to:

• supplier delays;

• freight delays;

• natural disasters;

• fire, flood, storm, or other weather events;

• industrial action;

• material shortages;

• import delays;

• power outages;

• government restrictions;

• pandemics;

• technical or website failures.

23. Privacy

Rivergum Range may collect and use customer information to process orders, arrange delivery, provide customer service, manage accounts, and communicate with customers.

Personal information will be handled in accordance with our Privacy Policy, where applicable.

24. Errors and Website Availability

We do our best to keep the website accurate and available, but we do not guarantee that the website will always be error-free, uninterrupted, or current.

We may update, change, suspend, or remove website content at any time.

25. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any disputes will be handled in accordance with the laws and courts of Victoria, Australia, subject to any rights you may have under Australian Consumer Law.

Rivergum Range may update these Terms & Conditions from time to time.
